State Penalties for Marijuana Cultivation
The state’s position on marijuana has loosened a little bit, but if you are caught cultivating the plant, particularly on a large scale, you could be facing severe fines and lengthy prison sentences. The level of punishment also depends on how much of the drug you have been cultivating. Typically, you could face the following penalties for cultivating marijuana:
- Less than 10 lbs: incarceration for 3 to 8 months and $1,000 fine
- 10–50 lbs: incarceration for 2 to 2.5 years and $5,000 fine
- 50–2,000 lbs: for 3 to 3.5 years and $25,000 fine
- 2,000–10,000 lbs: incarceration for 6 to 7 years and $50,000 fine
- More than 10,000: incarceration for 14.5 to 18 years and $200,000 fine
Federal Penalties for Marijuana Cultivation
Under federal law, the government treats marijuana cultivation similar to the manufacture of other Schedule I drugs (those that have a high potential for abuse and no currently accepted medical use in the United States). If someone is prosecuted by the federal government for the cultivation of less than 50 marijuana plants, they can spend up to 5 years in prison or up to a possible life sentence for 1,000 or more plants.
